ISO/RTO Consolidated Request for CFTC Exemption from Regulation
February 7, 2012 – Today the California Independent System Operator Corporation (California ISO), Electric Reliability Council of Texas (ERCOT), ISO New England, Inc. (ISO-NE), MISO, New York Independent System Operator (NYISO), and PJM Interconnection, L.L.C. (PJM) (“ISO/RTOs”) filed a consolidated request with the U.S. Commodity Futures Trading Commission (“CFTC”) for exemption from regulation under the Commodity Exchange Act (“CEA”) for each of the respective ISO/RTOs, and for all transactions and services provided, and participants, in their markets.
The ISO/RTOs made this consolidated request under a special provision of the CEA added by Congress in the Dodd-Frank Act authorizing the CFTC to grant exemptions for ISO/RTO transactions and services offered under tariffs or protocols approved by the Federal Energy Regulatory Commission (“FERC”) or a state public utility commission. The request asks the CFTC to grant an exemption because it is in the public interest, and without deciding whether any of the transactions or services provided by the requesting ISO/RTOs are subject to the CFTC’s jurisdiction. It is expected that the CFTC soon will publish the ISO/RTOs exemption request for public comment.
